A 12-year-old girl’s claim that she was seriously injured by a foul ball while watching a game at US Baseball’s national team trials is not precluded by the primary assumption of risk doctrine, an appeals court in California ruled. Recent steps taken to extend netting in baseball stadiums indicate that safety measures can be taken without fundamentally altering the nature of the game.
