SACRAMENTO, Calif. (CN) - Settling claims that malpractice led to the death of a cancer patient, Kaiser has agreed to pay the man's widow and son $575,000.
Christine Seevers and her son, Caden, had been set to take their wrongful death action to trial next month in Kaiser Arbitration/ Office of the Independent Administrator.
Instead Monday, they filed a petition for the Sacramento County Superior Court to approve a compromise they reached with Kaiser Foundation Hospitals.
Kaiser will pay the pair $575,000 to settle claims that it caused the May 2011 death of Christopher Seevers by failing to diagnose and treat bleomycin-induced lung toxicity while he was undergoing cancer treatment.
The father's obituary in the Sacramento Bee said he was just 28 years old when he died on his fifth wedding anniversary.
The petition says 5-year-old Caden will take $125,000 of the settlement, and the rest will go to his mother.
They also sought approval to direct about $42,900 from the settlement as attorneys' fees.
Eric Ratinoff of Kershaw, Cutter & Ratinoff had represented the family.
The petition notes that Ratinoff expects an additional $175,194 in fees and costs from Christine Seevers.
