OLATHE, Kan. (CN) - A girl says she was raped by the man who was counseling her for a previous rape. She sued Archeaus Emil Godwin, of Kansas City, Kan., and the TLC for Children and Families Residential Treatment Facility of Shawnee Mission.
In her complaint in Johnson County Court, Jane Doe says Godwin raped her on May 9, 2009 during the course of treatment.
Doe sought counseling for the trauma of being raped 3 years earlier, according to the complaint. Doe was a minor when Godwin took her and two other residents of TLC to Antioch Park in Merriman, Kan., for a "privilege outing," according to the complaint.
"During the outing at Antioch Park, Godwin sexually assaulted and raped Jane Doe in a public restroom," the complaint states.
Doe said Godwin admitted it.
"I did know that I should not be having sex with her anyway and I also knew that she was under my care as her supervisor," Godwin said, according to the complaint.
"I am an ass for taking advantage of my job, taking advantage of that especially when (Jane Doe)'s parents gave us the responsibility and trusted that their daughter was OK and not getting taken advantage of. They trusted that I would be taking care of her and others.
"I took advantage of my position as a supervisor over her."
Doe said other patients had complained about Godwin and accused him of being a pedophile before she was attacked. Instead of investigating Godwin, she says, TLC simply moved him to a different wing.
Doe seeks damages for injuries, chronic behavioral disorders, loss of self-esteem, embarrassment, disgrace, humiliation, post-traumatic stress disorder and diminished earning capacity. She is represented by J. Brett Millbourn with Walters Bender Strohbehn in Kansas City, Mo.
