Gap in Gap’s diversity?

SAN FRANCISCO — The Ninth Circuit upheld dismissal of a securities class action claiming that Gap made false or misleading statements to shareholders about its diversity commitments. The appellate panel found that the store’s forum-selection clause is valid and states the Delaware Court of Chancery is the exclusive forum for any derivative action.
