RICHMOND, Va. — The Fourth Circuit agreed to rehear en banc a suit challenging the dress code at a North Carolina public charter school, which requires girls to wear skirts to school. A three-judge panel of the court previously determined that sex discrimination claims relating to dress codes are “not categorically excluded from the scope of Title IX” but also found that because the school was not a state actor it was not “subject to an equal protection claim.”
