U.S. Courts Of Appeal

MEDICAID - The Fourth Circuit held that the secretary of the Department of Health and Human Services properly determined that it overpaid a medical supply company over $500,000 in reimbursement payments for 135 power wheelchairs that the company provided to Medicare recipients. MacKenzie Medical v. Leavitt

SETTLEMENTS - A class member who sued American Honda Motor Co. challenged an order that he post a $150,000 bond for costs on appeal. The Fifth Circuit reduced the amount to $1,000 because the cost of delay on appeal is captured by the $10 million settlement amount. Hawthorn v. American Honda Motor Co.
