Target Customer Can’t Pursue Class Action

(CN) – A customer who settled her individual claim that Target sent her an unsolicited credit card lost her interest in a class action, the 7th Circuit ruled.

A lower court refused to grant class status to Christine Muro’s lawsuit against the retail giant.
Muro then settled her claim that Target violated the Truth in Lending Act, but appealed the lower court’s denial of class certification.
“[W]e can discern no live, concrete controversy between Ms. Muro and Target that can justify permitting her to appeal the district court’s determination with respect to the certification of the class,” wrote Judge Ripple of the Chicago-based appellate panel.
