SCOTUS Wiggins and Black certiorari denials

U.S. Supreme Court Justice Sonia Sotomayor penned two dissenting opinions after the high court denied petitions for certiorari sought by criminal defendants.

Justice Sonia Sotomayor expressed frustration at a circuit split over the proper definition of a “controlled substance offense” under the federal sentencing guidelines in one case and encouraged a Tennessee appellate court to address “constitutional flaws” in the state’s approach to jury instructions in voluntary manslaughter cases in another.
