MANHATTAN (CN) - The U.S. attorney will not appeal a judge's ruling that will bar a key witness from testifying in the terrorism trial of Ahmed Khalfan Ghailani, the first Guantanamo to face a trial in the regular U.S. court system. U.S. District Judge Lewis Kaplan ruled testimony from Hussein Abebe inadmissible because government allegedly learned of him from "coerced statements" extracted from Ghailani. Ghailani's attorneys say he was tortured in an overseas CIA prison.
U.S. Attorney Preet Bharara's office is prosecuting Ghailani for the bombings of two U.S. Embassies in Africa in 1998. The attacks killed 224 people.
