N.Y. Appellate Divisions

LEGAL MALPRACTICE - Defendant attorneys asserted that plaintiffs could not have succeeded in underlying actions because the wires and construction debris over which plaintiff allegedly tripped were open and obvious conditions. The appellate division allowed plaintiffs to proceed with their legal-malpractice action over their attorneys' alleged failure to conduct proper discovery.
