Pot Possession Not Probable Cause

ANNAPOLIS, Md. – The Maryland Court of Appeals ruled that police officers unlawfully searched a man after smelling marijuana in his car and observing a joint in the center console. The officers did not have probable cause to believe the man was in possession of a criminal amount of marijuana, and possession of less than 10 grams of pot is a civil – not an arrestable – offense.
