Improper Comments

An appeals court in Texas ruled that a trial court judge improperly commented on the weight of the evidence and fabricated hypotheticals in a felony assault case in which a woman said her husband “pinched her nose, covered her mouth and pressed her face into a couch cushion.”

HOUSTON — An appeals court in Texas ruled that a trial court judge improperly commented on the weight of the evidence and fabricated hypotheticals in a felony assault case in which a woman said her husband “pinched her nose, covered her mouth and pressed her face into a couch cushion.” The court ruled the judge’s improper comments “substantially influenced” the jury’s decision to convict the man.
