NEW ORLEANS — The Fifth Circuit upheld a Texas federal court’s determination that the Bureau of Alcohol, Tobacco, and Firearms has no authority to regulate part kits that might be incorporated into a firearm under the existing text of the Gun Control Act. The lower court improperly vacated the bureau’s entire final rule, though, instead of only the challenged portions.
