FRESNO (CN) - An environmental group wants the U.S. Forest Service to re-examine its decision allowing a ranch to divert part of Fay Creek in the Sequoia National Forest. The diversion allegedly wiped out the rainbow trout in Fay Creek, increased grazing, and caused the creek to dry up for part of the year, preventing fish passage and causing other environmental damage.
Sequoia ForestKeeper sued the agency in Federal Court, claiming it flouted the "hard look" requirement of the National Environmental Policy Act when it issued a 10-year diversion permit to Quarter Circle Ranch.
It says the agency needs to consider the diversion's impact on downstream fish and animal species, water quality and surrounding rangeland, among other things.
Sequoia ForestKeeper seeks injunctive relief. Its lawyer is Hilton Williams with Paul, Hastings, Janofsky & Walker LLP.
