First Amendment

NEW ORLEANS – The Fifth Circuit affirmed that a professor may pursue First Amendment retaliation claims against the University of North Texas after he was removed as editor of an academic journal for publishing an article defending a theorist against charges of racism. The university’s alleged decision to end funding for the journal is “fairly traceable” to the Board of Regents.
