In a wage dispute brought by a group of truck drivers, the Fifth Circuit ruled that, in all Fair Labor Standards Act class actions, lower courts must rigorously assess whether potential class members are “similarly situated” from the outset of a case and “not after a lenient, step-one ‘conditional certification.”
