NEW ORLEANS — The Fifth Circuit reversed a Texas federal court’s determination that there was an unconstitutional limitation in the state’s DNA-testing statute related to death row inmates’ entitlement to testing. The appeals court found that new testing would not override the overwhelming evidence of this defendant’s guilt, especially considering that he admitted to orchestrating the robbery that resulted in a death.
