LOS ANGELES — A California appeals court ruled that a Donkey Kong world record-holder can pursue a defamation claim against the arcade game’s maker after it issued a statement that his world record scores were not achieved on original, unmodified hardware and banned him from participating in its leaderboards. The record-holder has presented evidence from the arcade game contest organizers and eyewitnesses that he did not have access to the game’s hardware before obtaining his score.
