NEW ORLEANS — In a civil rights suit arising from the death of Tony Timpa, who died while being restrained by Dallas, Texas, police officers after he called 911 while having a mental health crisis, the Fifth Circuit ruled an officer was not entitled to qualified immunity on an excessive force claim and three other officers were not entitled to immunity on bystander liability claims.
