LOS ANGELES (CN) - The U.S. Justice Department cheats people of interest earned on money they seize for forfeiture, then must return when charges are dismissed or not even filed, a class action claims in Federal Court.
The Justice Department places the seized money in interest-earning accounts and must return the money, with interest, if the case is dismissed or not filed, the putative class claims. Named plaintiff Cherise Touhey says the 6th, 9th, and 11th circuits have declared so. She says the USA has cheated people of millions of dollars this way. She is represented by Eric Honig of Marina del Rey.
