A bar employee who was visiting the establishment when he threw out an intoxicated man who had punched someone is not entitled to immunity in a negligence dispute, the Wisconsin Supreme Court ruled, finding the employee was not a “lawful occupant of real property” when he released the patron, who suffered serious injuries, by a stairway.

MADISON, Wis. — A bar employee who was visiting the establishment when he threw out an intoxicated man for having punched someone is not entitled to immunity in a negligence dispute, the Wisconsin Supreme Court ruled, finding the employee was not a “lawful occupant of real property” when he released the patron, who suffered serious injuries, by a stairway.
