ZONING - Arizona challenged the dismissal of misdemeanor charges against two sexually oriented businesses that sold adult magazines. J. Irvine cited studies showing that bans on night-operated adult businesses decrease secondary effects such as property crimes, illicit drug use and prostitution. Thus, there is a sufficient connection between the regulated speech and the secondary effects. See ruling.

Timmer found that the trial court failed to consider whether Mobilisa's interests in disclosure outweigh the speaker's privacy interests. Remanded. See ruling.
