PRISONERS RIGHTS, ATTORNEYS - The state appeals court found that when an indigent defendant files an untimely petition for post-conviction relief, the state constitution guarantees the defendant a limited right to have a court-appointed counsel investigate whether the defendant might qualify for one of the exceptions or tolling periods for that statute of limitations. Reversed. See ruling.
