Accidental traffickers

NEW ORLEANS — The Fifth Circuit reversed the conviction of two vehicle passengers for possession with intent to distribute more than 100 kilograms of marijuana. When the two were questioned by the DEA, they both said they were strangers who crossed the border together and flagged down a random car for a ride; the driver later dropped them off and came back with a car loaded with drugs. The jury could not reasonably conclude based on this that either passenger possessed the drugs with an intent to distribute.
