Invisalign ‘puffery’

SAN FRANCISCO (CN) — The Ninth Circuit upheld the dismissal of a class-action securities fraud lawsuit against the manufacturer of Invisalign braces, which is accused of misrepresenting how well the company would perform in China. The statements were optimistic “puffery,” not actionable, fraudulent claims.
