CINCINNATI — The Sixth Circuit revived a death row inmate’s facial claim challenging the constitutionality of Tennessee’s lethal injection protocol, which involves the use of a combination of three drugs. The inmate, who proposes pentobarbital as one alternative to the current protocol, has plausibly alleged that the drug is available to the state for use in executions.
