LOS ANGELES (CN) - The California Department of Healthcare Services refuses to pay for AIDS drugs for low-income Medi-Cal recipient, the AIDS Healthcare Foundation claims in Superior Court.
The California DHS provides funding for the foundation's Positive Healthcare Plan, which provides primary care case management for Medi-Cal recipients who have HIV/AIDS.
The contract calls for the department to reimburse the foundation after it pays for AIDS drugs for low-income members, the complaint states.
The foundation claims the department is to reimburse it with a monthly "capitulation fee" for certain drugs for each member of the plan, and for other "out of cap" drugs, which the department reimburses at the regular Medi-Cal rate. But the department is refusing to pay for the "out of cap" drugs, the complaint states.
The foundation demands damages for breach of contract. It is represented by Tom Myers and John Dratz Jr.
