ATLANTA (CN) - Viewers of NBC's "Deal or No Deal" game show are not entitled to a refund of their text-message fees, the Georgia Supreme Court ruled.
A class of Georgia viewers sued over the "Lucky Case" game, which allows viewers to choose one of six cases. They can play for free on the Internet or they can send their vote by text for 99 cents.
The plaintiffs sued under a Georgia law that allows the loser of a gambling action to bring a civil action against the winner.
Justice Thompson agreed with the district court that this was not a gamble because the 99-cent fee never hung in the balance during the game.
