SACRAMENTO (CN) - The State Aeronautics Act does not require Sacramento County to renew the conditional-use permit for continued operation of Sunset Skyranch Airport, a California appeals court ruled.
While the act's stated purpose is to encourage aviation, it does not compel the county to allow continued operation of the privately owned airport, public-use airport, Justice Sims ruled.
But because the denial of the permit renewal will result in the airport's closure, Sims added, the project requires an initial study under the California Environmental Quality Act.
