8th Circuit

TORT - After the electrocution of a U.S. Army private, his estate sued a private contractor in charge of maintenance and repairs at Fort Benning. The 8th Circuit held that the defendant had a duty to remove the structure that caused the private's death, and that a reasonably careful person would have foreseen the appreciable risk of harm that the failure to remove the structure created.
