5th Circuit

MARITIME - The Rice Co. chartered a vessel owned by Precious Flowers Ltd. to ship rice to Togo, but the ship had unseaworthy hatch covers and the rice was damaged in transit. The charter required arbitration in New York. The 5th Circuit ruled that the terms of the arbitration agreement only bind the disponent owner to arbitration, not the ship's owner.
