4th Circuit Allows Lawsuit Over Piney Run Pollution

RICHMOND, Va. (CN) - The 4th Circuit refused to dismiss a citizen lawsuit accusing Carroll County commissions of violating the Clean Water Act by dumping treated wastewater into a small stream in Maryland called Piney Run.

The court rejected the commissioners' motion to dismiss, ruling that the Maryland Department of the Environment was "diligently prosecuting" a Clean Water Act enforcement action against the county.
