You Think You’ve Got Problems?

AUSTIN (CN) - In an employment case that springs from a medical nightmare, a man claims Daiichi Pharmaceuticals fired him because he is HIV positive, and that it found he is HIV positive because he was charged with drunk driving after crashing a company car while "sleep driving" on Ambien.

He says Daiichi demanded all the documents in his DUI case, and he told the company that he did not submit to a blood alcohol test for fear of revealing his HIV status. He says the arresting officer did not offer him the choice of a Breathalyzer test.

The man sued Daiichi pro se in Travis County Court. He claims Daiichi fired him before his DUI case was adjudicated, which caused him to lose his home to foreclosure and lose his medical insurance, which caused his disease to develop into AIDS and AIDS-related pneumonia. And, he says, his daughter had to drop out of college to support the family. He says he was making $86,000 a year, plus bonuses, as a sales rep before the May 2005 "sleep driving" set off the chain of disasters.
