Yankees Accused|of Age Discrimination

THE BRONX (CN) - Thirteen older workers say the New York Yankees discriminated against them by refusing to let them keep their jobs at the new Yankee Stadium. When they reapplied for their jobs, the men say the team asked them all, "What could someone 73 years old offer the Yankees?"

Guido Caceres and a dozen others sued the team in Bronx County Court. All 13 say they were buffet servers for more than 20 years at the Stadium Club in the old Yankee Stadium. They say the Yankees told them their services would not be needed at the new ballpark because there would be no buffet service. They lost their jobs in October 2008.

But the men say the Yankees actually have two buffet services at the new park: the Legends Club and the Audi Yankee Club. They say that when they applied for their old jobs at the new stadium, the team told them their applications had been lost and they would have to reapply.

Then, the men say, "When the plaintiffs re-applied for the buffet server position, each was asked during the interview process, 'What could someone 73 years old offer the Yankees?'"

The plaintiffs, represented by Harry Hertzberg, demand $3 million.
