Would-Be Guam Governor Loses Election Challenge

(CN) - A candidate for governor of Guam lost his challenge to the election results in the U.S. territory's Supreme Court.

Carl T.C. Gutierrez sued the Guam Election Commission after losing the Nov. 6 election to Edward Calvo by a count of 20,066 to 19,579.

Gutierrez asked the court to vacate the election results based on his claim that the commissioners were not appointed as required under the Guam Election Code.

The Guam Supreme Court declined on Thursday to grant Gutierrez's request for a writ of prohibition, stating that the validity of the commissioners is not relevant to the election.

"No evidence was introduced of misconduct, fraud or abuse of discretion, such as a conspiracy that would threaten justice and democracy," Justice Robert Torres Jr. wrote for the court.
