A workers’ compensation board improperly rescinded partial disability awards issued to an undocumented construction worker after finding that he did not prove had adequately searched for other jobs, an appeals court in New York ruled. The worker, who does not speak or read English well, applied to work with 62 businesses over a six-month period and used the services of a job-location firm.

ALBANY, N.Y. — A workers’ compensation board improperly rescinded partial disability awards issued to an undocumented construction worker after finding that he did not prove he had adequately searched for other jobs, an appeals court in New York ruled. The worker, who does not speak or read English well, applied to work with 62 businesses over a six-month period and used the services of a job-location firm.
