SAN JOSE (CN) - The Options National Fertility Registry has filed a class-action contract case accusing The American Society for Reproductive Medicine and the Society for Assisted Reproductive Technology of fraud, conversion and tortious interference: giving the ova of plaintiff's registered members to unknown and unauthorized women without consent.
The alleged abuse is called "an industry-wide practice ... known as 'egg sharing.'" Both defendants are headquartered in Birmingham, Ala., and do business in California. Plaintiffs claim the defendants cannot account for missing ova, and their records are suspiciously inconsistent. Represented in Federal Court by Stanley Hilton of San Francisco, plaintiffs seek punitive damages. See complaint.
