Woman Wasn’t Fired for Lactating, Court Rules

(CN) - An Ohio woman who claimed she was fired for lactating was actually let go for other, legitimate reasons, the Ohio Supreme Court ruled.

The justices affirmed the findings of the appellate court that LaNisa Allen lost her job at totes/Isotoner because, for about two weeks, "she had taken breaks without her employer's knowledge or authorization to do so," even though her supervisor "told her that she would be terminated for her failure to follow directions.

Allen did not prove that this reason was a mere pretext for firing her because she was pregnant or lactating, the state high court ruled.

Because of this, the justices did not issue an opinion over whether lactation would be included under Ohio's employment discrimination law.
