Woman Says Wal-Mart Dress Inflamed Her

MIAMI (CN) - A Wal-Mart dress sent a customer to the hospital with heart palpitations and "an excruciatingly painful red rash over large portions of her body" that lasted for months, the woman claims in court.

Aracely Gonzalez sued Wal-Mart Stores in Miami-Dade County Court. She bought the dress 3 years ago at the Wal-Mart Supercenter in Haileah Gardens.

The day after she wore it, Gonzalez says, she "developed an excruciatingly painful red rash over large portions of her body, which required her to go to Palm Springs General Hospital, where she was diagnosed with allergic dermatitis."

Eight days later she went to the hospital again, with palpitations.

"The painful rash lasted for a period of several months, with several outbreaks," she says in the complaint.

An allergist finally "informed Gonzalez that the cause of the dermatitis was the dress that she had purchased at Wal-Mart," according to the complaint.

Gonzalez seeks damages for negligence, strict liability and breach of warranty. Her Husband seeks damages for loss of consortium.

They are represented by Tomas Gamba, with Gamba, Lombana & Herrera, in Coral Gables.
