Woman Says Pesticides Gave Her Severe Burns

WEST PALM BEACH, Fla. (CN) - A pest control employee doused a Boca Raton woman with pesticides, leaving her with third-degree burns, the woman claims in circuit court.

Dawn Miller, who began renting her home in July 2009, says the mishap occurred three months later, when, unbeknownst to her, her landlord, defendant William Schmearer, hired Van Sant Pest Management Inc. to treat the property.

According to the lawsuit she filed in the Palm Beach County Circuit Court, she was checking on why her dog was incensantly barking outside, when she walked around the side of her home and was sprayed with pesticides and other harmful chemicals.

Miller says at no time was she notified the spraying would be taking place, nor did anyone check to see if the occupants were home before starting to spray or inform her before they arrived.

She says the incident left her with severe and permanent injuries caused by third-degree chemical burns on her neck, face and back.

Miller is seeking unspecified damaged from the defendants, which also includes property manager Wes Management Inc. on multiple claims of negligence.

She is represented by Stephan Leclainche of Babbit, Johnson, Osborne & Leclainche PA of West Palm Beach.
