Woman Says Mo. Deputy Forced Her for Sex

ST. LOUIS (CN) - Under the threat of arresting her husband, a sheriff's deputy coerced a woman into a hotel room where he drugged and forced her to have nonconsensual sex, the woman claims in court.

The woman, known only as Jane Doe, sued Gasconade County, former Gasconade County Deputy Marty Rainey and Gasconade County Sheriff Randy Esphorst in federal court on Monday.

Doe claims Rainey called her 87 times and sent her 1,288 text messages - most of which were sexually explicit - between July 14, 2012, and August 6, 2012.

After threatening to arrest her husband on trumped up charges, the lawsuit claims Rainey told Doe that he could use his authority to "make this all go away" if the plaintiff had sex with him.

On Aug. 6, 2012, Doe claims Rainey picked her up while in full police uniform and drove her to a hotel in his police vehicle where he told her to get a room under a fake name.

Once they were in the room, Doe says in the complaint that Rainey gave her an opened can of soda that caused her to feel "drugged." Doe claims Rainey placed his police-issued gun on the nightstand next to the bed "with the barrel of the firearm pointing towards where the plaintiff was laying," before having sexual intercourse with her, despite Doe's resistance.

Rainey, 51, was charged earlier this year with forcible rape, acceding to corruption by a public servant, statutory rape and the use of a child in a sexual performance. Court records show Rainey is currently released on a $100,000 bond and is subject to 24-hour GPS monitoring.

The charges came after an investigation by the Missouri Highway Patrol that was requested by Esphorst after receiving several complaints about Rainey, the St. Louis Post-Dispatch reported. It is unclear whether the charges are directly related to Doe's claims.

Rainey resigned as Gasconade County deputy sheriff in November 2012.

Gasconade County Presiding Commissioner Larry Miskel told Courthouse News that he's aware of the investigation into Rainey, but the county had no comment regarding Doe's lawsuit.

Doe seeks punitive damages for violations of her constitutional rights, intentional infliction of emotional distress, false imprisonment, failure to supervise and negligent supervision. Doe is represented by Thomas E. Schwartz of Holloran Schwartz & Gaertner.

Gasconade County, pop. 14,972, is a mostly rural conservative county that is 97.2 percent white 80 miles west of St. Louis. Mitt Romney took 69 percent of the county's mainly Protestant votes in the last presidential election, according to city-data.com. The median household income in Gasconade County for 2013 was $40,999, almost $6,000 below the state average.
