MINNEAPOLIS (CN) - A Medtox employee sexually assaulted a woman while administering a medical test, and the company had retained him though it knew he had assaulted another woman in similar circumstances, a woman claims in Hennepin County Court.
The plaintiff claims Benjamin Lewis sexually assaulted while administering a urine test she was providing as part of random drug testing for her airline employer.
"Plaintiff was not the first woman Lewis assaulted under similar circumstances," she says. "The other woman reported his earlier assault prior to plaintiff's assault."
The plaintiff says she reported the assault to the police, to the airline and to the FAA, after which the clinic fired Lewis.
She also sued Park Nicollet Health Services, which has a contract with Northwest Airlines to administer random drug tests.
The plaintiff is represented by Gerald Laurie of St. Louis Park, Minn.
