Woman Says Her Rapist’s Former Employer,|Security Firm, Threatens to Reveal her Name

NASHVILLE (CN) - The daughter of a prominent Nashville family who was kidnapped and raped at gunpoint by a private security guard says an attorney for her rapist's employer, Brentwood Patrol, sent her a "demand package" claiming that she lied about the rape and will be exposed if she does not pay Brentwood $1 million. She says the demand package includes a draft of a lawsuit that she believes Brentwood intends to file.

Jane Doe says Brentwood security guard Loren Janosky raped her at gunpoint in August 2002 while on patrol for the City of Forest Hills, a client of Brentwood Patrol. He was in a car "that was outfitted to look like a police car" when he pulled her over, handcuffed her, and raped her at gunpoint.

"Mr. Janosky threatened to kill Jane Doe before he returned her to her car and left her," according to the complaint.

Janosky pleaded guilty to kidnap and rape and was sentenced to 18 years in prison, according to Doe's complaint in Davidson County Court.

Doe says she sued Brentwood Patrol in state court and the City of Forest Hills in Federal Court - both times under a pseudonym, because of the nature of the charges. She says the "considerable media coverage" of the criminal proceedings and of both of her lawsuits always referred to her by the pseudonym.

"Both the state court lawsuit and the Federal Court lawsuit were settled and resolved on confidential terms in 2004," Doe says.

Doe says that in November 2009, she "received a package of materials including an unfiled draft lawsuit (collectively, the 'demand package') from Brentwood Patrol's attorney. The demand package accuses Ms. Doe of lying about being raped, and bases its accusations on a series of handwritten letters ostensibly bearing the dates from May 4, 2003 to January 7, 2009 purporting to be from Ms. Doe to Mr. Janosky in prison. The demand package implicitly threatened to expose Ms. Doe's identity unless she pays Brentwood Patrol the sum of $1,000,000.

"The purported letters are a series of rambling sexual fantasies interspersed with confessions. They contain terrible spelling, improper grammar and contain almost no personal information that would allow them to be verified.

"The letters are false and forged. Ms. Doe did not write, authorize, approve, or have knowledge of any letters prior to receiving the demand package. ...

"Ms. Doe has reason to believe that Mr. Janoksy [sic] and/or his accomplices authored the letters.

"Ms. Doe believes that Brentwood Patrol intends to file the lawsuit. The disclosure of Ms. Doe's identity as the victim of rape in 2002 will be extremely and irreparably damaging to both Ms. Doe and her family. The threat of litigation has already caused her significant emotional distress, and the disclosure of her identity via the filing of the lawsuit that has been threatened would greatly exacerbate these damages."

She wants Brentwood Patrol, its principal Tommy Thompson, its employees, agents, attorneys and other third parties restraining from filing any claim against her without using a pseudonym to protect her identity, or without filing it under seal, and she wants them enjoined from revealing her identity to any third party or new organization "except as may be necessary for Brentwood Patrol to prosecute its lawsuit."
