Woman Says ‘Glee’ Two-Timer Beat Her

LOS ANGELES - (CN) - Mark Salling, a star of the "Glee" TV show, forced a girlfriend to have unprotected sex and assaulted her when she came to his house wanting to know if he was clean, the woman claims in court.

Roxanne Gorzela sued Mark Salling in Superior Court.

Salling plays Noah Puckerman on the Fox TV show "Glee," about high school kids. Salling is the only defendant in the complaint.

In her complaint, Gorzela claims she started dating Salling in September 2010, and that he "knew plaintiff did not consent to unprotected sexual intercourse" with him.

But in March 2011, Gorzela says, she "met with defendant before plaintiff was to go to Canada for the weekend. As plaintiff and defendant began to engage in personal and intimate contact, defendant intentionally, and without plaintiff's consent, inserted his penis into plaintiff's vagina without a condom."

The complaint continues: "Following defendant's offensive contact with plaintiff's intimate parts, plaintiff immediately stopped and asked defendant, 'What are you doing?' Plaintiff then demanded that defendant wear a condom before engaging in sexual intercourse with plaintiff.

"However, shortly after plaintiff's demand that defendant wear a condom, and although defendant was aware that plaintiff did not consent to unprotected sexual intercourse, defendant violated plaintiff again by inserting his penis into plaintiff's vagina without a condom for a second time."

This unprotected sex "intended to, and did, cause harmful and offensive contact to an intimate part of plaintiff's body, and sexually offensive contact with plaintiff directly occurred," Gorzela says in her complaint.

"At no time did plaintiff consent to defendant's offensive contact with the intimate parts of her body. At all times, defendant was aware that plaintiff did not consent to unprotected sexual intercourse with defendant.

"In the days following the incident detailed above, plaintiff became overwhelmed with anxiety, apprehension and distress as she became concerned about the possibility of having contracted a sexually transmitted disease from defendant.

"Plaintiff attempted to contact defendant in order to ask defendant when the last time he had unprotected sex was. Plaintiff also asked defendant to show plaintiff his STD test results. Defendant would not respond to plaintiff and ignored plaintiff's phone calls and text messages, causing plaintiff to grow increasingly concerned.

"On or about March 14, 2011, plaintiff fainted as a result of the anxiety, anguish and emotional distress she has suffered from defendant's harmful and offensive sexual contact with her body."

The next day, Gorzela says, she went to her doctor to get an exam and a blood test.

When she stopped by Salling's house that evening to talk to him about her anxieties, she says, she found him "in his room with another woman in his bed."

Gorzela says she "demanded that defendant prove to her that he was clean and that he had no sexually transmitted diseases. Immediately thereafter, defendant grabbed plaintiff and pushed plaintiff to the ground where plaintiff landed on her knees and hit her head."

Gorzela says Salling's "wrongful and outrageous conduct" has made her suffer "embarrassment, humiliation, anger mental anguish, and severe emotional distress."

She says she also "suffered knee contusions as a result of her fall."

Gorzela seeks punitive damages for sexual battery, assault and battery, intentional infliction of emotional distress and negligence.
