Woman Must Pay|$300,000 to Her Ex

ST. CHARLES, Mo. (CN) - A St. Charles County jury awarded $300,000 to the ex-husband of a woman who negligently caused the death of their 6-week-old son, the St. Louis Post-Dispatch reported.

The infant died of accidental suffocation on Nov. 19, 2009.

The infant's mother, Alyssa Kley, 43, of Lake St. Louis, was charged with child endangerment after she told investigators that she had three or four glasses of wine before she went to sleep.

Blood taken from Kley nearly 4 hours after she reported the infant's death showed her blood alcohol content was 0.20 percent, two and a half times Missouri's legal limit of .08 percent. The child endangerment charge was dropped after a grand jury decided not to indict her.

Joseph Potter, 49, of St. Charles, sued Kley shortly before their divorce was finalized last year.

The verdict included $100,000 in actual and $200,000 in additional damages for aggravating circumstances.
