Woman Hospitalized Twice by Hellish Elevator

CLEVELAND (CN) - An elevator plunged multiple floors twice, a month apart, with the same woman inside, the second time so severely it dislocated her private parts, she claims in court.

Barbara J. sued Schindler Elevator Corp. and the owners and managers of her Cleveland apartment building, the Euclid Beach Villa Apartment, in the Cuyahoga County Court of Common Pleas.

Barbara J. lives on the twelfth floor.

The first accident came on Aug. 11, 2010, when "the elevator did suddenly malfunction and drop to the first floor before coming to a stop." She suffered injuries to her shoulder, back, knees, abdomen and pelvic region, which were treated at a hospital, according to the lawsuit.

One month and 3 days later, on Sept. 14, she got on the same elevator. "(A)fter making one stop on the eleventh floor, the elevator did suddenly malfunction and drop several floors before coming to a stop," she says.

This time, she suffered an "exacerbation of her injuries from the first elevator incident, prolapse of her rectum and vagina, and a right foot injury," which again required treatment at a hospital, she says.

She seeks damages of more than $15,000 for negligence.

According to statistics on the ConsumerWatch website, around 27 people are killed in the United States each year in elevator accidents. Most victims are repair workers. More than 10,000 people are injured each year in elevator accidents.

Barbara J. is represented by Kenneth Abbarno with the Skolnick Weiser Law Firm.

Named as defendants along with the elevator company are GH Capital LLC, PK Management LLC, and five John Does.
