MANHATTAN (CN) - After a cab driver called 911 to say a drunk woman needed help getting into her apartment, an NYPD officer took advantage of her by raping her while his partner stood lookout, the woman claims in Federal Court.
After the cabbie called the NYPD in the early morning hours, Officers Kenneth Moreno and Franklin Mata helped the woman into her apartment on East 13th Street, then "stole plaintiff's keys to the building and to her apartment," according to the complaint.
Jane Doe says the officers returned twice that night, "on foot and in uniform," and Moreno raped her, aided and abetted by Mata.
She seeks $7 million from New York City, Moreno and Mata, for assault and battery, unlawful imprisonment, trespass, emotional distress, civil rights violations and negligence. She is represented by Daniel Katz with Bauman Katz & Grill.
