Woman Claims Boss|Raped Her Repeatedly

SAN FRANCISCO (CN) - The manager of a San Francisco bar raped a bartender repeatedly, and his stepson shut a second woman in a room and demanded sex from her too, the women claim in court.

Marcela Torres sued Tony Mayorga, her alleged rapist, and Club 26 Mix, in Federal Court.

"Defendant Mayorga assaulted and raped Marcela Torres on multiple occasions," the complaint states.

Maria Altamirano also sued, claiming she too was subjected to "severe, pervasive sexual harassment" from Mayorga.

They also sued Club 26 Mix owners Jose Vallejo aka Ricardo Vallejo and the estate of Cesar Aguilar Mejia.

Torres says she worked at the club from 2007 to 2101, as a bartender and cashier.

Altamirano had the same jobs from 2008 to 2009.

"All they wanted was the opportunity to perform an honest day's work for an honest day's pay," the complaint states. "Instead, each woman was subjected to severe, pervasive sexual harassment from their supervisor, William Mayorga. Inappropriate comments escalated to unwanted touching, humiliation, threats, and, for Ms. Torres, numerous rapes. When plaintiffs opposed the harassment, Mr. Mayorga retaliated against them, but the abuse did not stop. Plaintiffs filed a complaint of discrimination with the Equal Employment Opportunity Commission to try to end the harassment and assaults. However, even after defendants were on notice of plaintiffs' allegations, Club 26 Mix did not investigate, prevent or remedy the harassment. Despite notice of Mr. Mayorga's unlawful and violent behavior, plaintiffs believe he continues to be employed at Club 26 Mix to this day."

The complaint adds: "Mr. Mayorga was not the only supervisor to participate in the pervasive harassment at 26 Mix. Mr. Mayorga's stepson, Giobani (LNU) shut Ms. Altamirano in a room and demanded sex on at least one occasions within the limitations period."

They seek lost wages and punitive damages for sexual harassment, retaliation, failure to pay minimum wage, overtime violations, failure to prevent harassment, unauthorized deductions from wages, coerced purchases and unfair and unlawful business practices.

They are represented by Julia Parish, with The Legal Aid Society-Employment Law Center.

According to its web page, checked this morning, Club 26 Mix is a bar in San Francisco's Mission District.
