Widow Says Police Chief Killed Husband

BIRMINGHAM, Ala. (CN) - York Police Chief David Rowry served an arrest warrant on a man as he ate at a Church's Chicken, and when the man asked why he was being arrested, Rowry shot him to death, the man's widow and four children claim in Federal Court. They say Rowry has been charged with manslaughter.

According to the widow's complaint, when her husband, Joe Louis Bell, "asked Chief Rowry why he was being arrested, Chief Rowry responded by shooting Decedent. ... Rather than immediately seeking medical help for Decedent, Chief Rowry handcuffed Decedent while he lay bleeding on the floor. ... Chief Rowry has been indicted by a Sumter County Grand Jury for manslaughter for the shooting of Joe Louis Bell."

The widow and kids demand damages for wrongful death, negligence, intentional tort, excessive force and constitutional violations. They are represented by Tasha Robert with Roberts & Bishop of Indianapolis, Ind.
