MANHATTAN (CN) - In a fight between heavyweights in the diet business, Weight Watchers International claims Campbell Soup is illegally using its "Weight Watchers" and "Points" trademarks on a new line of "Select Harvest Light" soups.
"The Select Harvest Light soup line displays the Weight Watchers and Points trademarks - in bright blue, stylized font in a prominent manner - on the product labels and on product displays at the point of sale, accompanied by a purported Points value for each product. WWI has not authorized or approved Campbell's use of WWI's trademarks," the complaint states.
Weight Watchers claims its "proprietary Points weight-loss system has been the core of WWI's weight-loss plan" since 1997. WWI says it licenses the trademarks to food companies, including soup companies.
Weight Watchers demands punitive damages for trademark infringement and dilution, unjust enrichment, false designation, and breach of contract. It is represented by Martin Flumenbaum with Paul, Weiss, Rifkind.
